Terms of Service
1. Agreement
By downloading or using OmniBrain AI (“App”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. The service
OmniBrain is a local-first knowledge app. Free features include unlimited local saves and search. Paid plans (Pro / Premium) unlock higher AI summary and transcript quotas and related features as described in-app. Feature availability may change; we will not reduce paid quotas mid-billing cycle without notice except for abuse or legal reasons.
3. Accounts and devices
The MVP does not require a cloud account. Access tokens for our API are bound to your device. You are responsible for securing your device and any PIN / biometrics you enable.
4. Subscriptions and billing
- Paid plans are billed through Google Play. Manage, cancel, or request refunds via Google Play policies.
- We verify purchase tokens server-side to unlock entitlements. Fraudulent or revoked purchases may result in downgrade.
- Prices shown in Play Console / the App control; taxes may apply.
5. Acceptable use
You may not use the App or API to: violate law; scrape or attack third-party services beyond ordinary personal saving; attempt to bypass quotas, billing, or authentication; upload malware; or reverse-engineer the service to build a competing cloud clone of our paid AI gateway.
6. Third-party content
You are responsible for the legality of URLs and files you save. Embedded players and articles remain subject to their publishers’ terms. OmniBrain does not grant you rights to copyrighted works.
7. AI outputs
Summaries, transcripts, and Ask Library answers may be inaccurate or incomplete. Do not rely on them as professional, legal, medical, or financial advice.
8. Disclaimer
THE APP AND API ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNIBRAIN AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU PAID NOTHING).
10. Termination
You may stop using the App at any time (uninstall / cancel Play subscription). We may suspend API access for abuse, non-payment, or legal risk.
11. Changes
We may update these Terms. Material changes will be posted on this page with a new effective date. Continued use after the effective date constitutes acceptance where permitted by law.
